My College Dentist will never be held responsible for the payment of any user’s usual, customary and any other charges for any medical or related services rendered by Healthcare Providers.

  1. Limits upon exclusions of liability

6.1      Nothing in this disclaimer will:

(a)       limit or exclude any liability for death or personal injury resulting from the sole negligence of My College Dentist;

(b)      limit or exclude any liability for fraud or fraudulent misrepresentation solely from My College Dentist;

(c)       limit any liabilities in any way that is not permitted under applicable law performed solely My College Dentist; or

(d)      exclude any liabilities that may not be excluded under applicable law performed solely My College Dentist.

 

Responsible Use and Conduct

By visiting our website and accessing the information, resources, services, products, and tools we provide for you, either directly or indirectly (hereafter referred to as ‘Resources’), you agree to use these Resources only for the purposes intended as permitted by (a) the terms of this User Agreement, and (b) applicable laws, regulations and generally accepted online practices or guidelines.

We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.

8.   We do not assume any liability for any content posted by you or any other 3rd party users of our website. However, any content posted by you using any open communication tools on our website, provided that it doesn’t violate or infringe on any 3rd party copyrights or trademarks, becomes the property of My College Dentist LLC, and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration process, necessary in order to use our Resources. All information provided as part of our registration process is covered by our privacy policy located at the bottom of this page.

9.   You agree to indemnify and hold harmless My College Dentist LLC and its parent company and affiliates, and their owners, directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.

10. The Resources are free to utilize for non-Healthcare Providers, but you are still responsible for your healthcare expenses. Privacy 

Your privacy is very important to us, which is why we’ve created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. Limitation of Warranties 

By using our website, you understand and agree that all Resources we provide are “as is” and “as available”. This means that we do not represent or warrant to you that:

  1. the use of our Resources will meet your needs or requirements.
  2. the use of our Resources will be uninterrupted, timely, secure or free from errors.
  3. the information obtained by using our Resources will be accurate or reliable, and
  4. any defects in the operation or functionality of any Resources we provide will be repaired or corrected.

Furthermore, you understand and agree that:

My College Dentist LLC will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

Copyrights/Trademarks 

All content and materials available on MyCollegeDentist.com, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of My College Dentist LLC, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by My College Dentist LLC.

We reserve the right to publish your Posted Information as part of the Resources and to also remove your Posted Information for any reason. We are not, however, responsible for any failure or delay in posting or removing Posted Information. Keep in mind that the Posted Information of others is simply opinion and should not be relied on.

Termination of Use

at any time in our sole discretion without notice or explanation, providing that if we cancel any Resources you have paid for and you have not breached these terms and conditions, we will refund to you a pro rata amount of your payment, such amount to be calculated by us using any reasonable methodology.

8.2      You may cancel your account by emailing us at support@mycollegedentist.com. You will not be entitled to any refund for the current month of membership if you cancel your account in accordance with this Section 8.2.

  1. Directory

9.1      We welcome submissions to the directory published on our website.

9.2      Each submission to our directory must be a listing in respect of a business owned by a properly licensed healthcare provider.

9.3      For the avoidance of doubt, your directory submissions constitute “your content” for the purposes of Section 15 and Section 16, and must comply with the acceptable use rules set out in Section 4.

9.4      You must keep your directory submissions up to date using our website interface.

  1. Free trial directory listings

10.1    You may submit a free trial listing to our directory by following this process: Visit the listing submission process page at https://mycollegedentist.com/submit-listing and follow the necessary detailed instructions.

10.2    If we accept your free-trial directory listing submission, it will remain published on our website for the relevant period set out on our website, subject to termination or deletion in accordance with these terms and conditions.

10.3    We may delete a free trial directory listing at any time, with or without notice to you.

  1. Paid directory listings

11.1    You may submit a paid listing to our directory by following this process: Visit the listing submission process page at https://mycollegedentist.com/submit-listing and follow the necessary detailed instructions.

11.2    You will have the opportunity to identify and correct input errors prior to making your order by editing your profile information using your account control panel on the website.

11.3    Paid submissions include the following benefits: but are not limited to and can change at any time, located on the website page https://mycollegedentist.com/dentist-benefits.

11.4    If we accept a paid directory submission, it will remain published on our website for the relevant period specified on our website, subject to termination or deletion in accordance with these terms and conditions.

11.5    We may delete a paid directory listing at any time, providing that if we delete a paid listing in accordance with this Section 11.5 before the end of the period in respect of which listing fees have been paid, we will refund to you a pro-rated portion of those listing fees reflecting the unexpired listing period, such amount to be calculated by us using any reasonable methodology.

  1. Prohibited directory submissions

12.1    Without prejudice to our other rights under these terms and conditions, we reserve the right to reject or delete directory submissions that breach these terms and conditions, or that do not meet the additional guidelines for submissions published on our website.

12.2    If we reject or delete a directory submission in accordance with this Section 12, we will not refund any applicable charges.

  1. Fees

13.1    The fees in respect of our website Resources will be as set out on the website from time to time.

13.2    All amounts stated in these terms and conditions or on our website are stated exclusive of tax.

13.3    You must pay to us the fees in respect of our website Resources in advance, in cleared funds, in accordance with any instructions on our website.

13.4    We may vary fees from time to time by posting new fees on our website, but this will not affect fees for Resources that have been previously paid.

13.5    If you dispute any payment made to us, you must contact us immediately and provide full details of your claim to support@mycollegedentist.com.

13.6    If you make an unjustified credit card, debit card or other charge-back then you will be liable to pay us, within 7 days following the date of our written request:

(a)       an amount equal to the amount of the charge-back;

(b)      all third party expenses incurred by us in relation to the charge-back (including charges made by our or your bank or payment processor or card issuer);

(c)       an administration fee of $25.00 excluding tax; and

(d)      all our reasonable costs, losses and expenses incurred in recovering the amounts referred to in this Section 13.6 (including without limitation legal fees and debt collection fees),

and for the avoidance of doubt, if you fail to recognise or fail to remember the source of an entry on your card statement or other financial statement, and make a charge-back as a result, this will constitute an unjustified charge-back for the purposes of this Section 13.6.

13.7    If you owe us any amount under or relating to these terms and conditions, we may suspend or withdraw the provision of Resources to you.

13.8    We may at any time set off any amount that you owe to us against any amount that we owe to you, by sending you written notice of the set-off.

  1. Our role

14.1    You acknowledge that:

(a)       we do not confirm the identity of website users, check their credit worthiness or bona fides, or otherwise vet them;

(b)      we do not check, audit or monitor the information contained in advertisements or listings;

(c)       we are not party to any contract for the sale or purchase of products, digital products or services advertised or listed on the website;

(d)      we are not involved in any transactions between website users in any way;

(e)       we are not the agents for any website users,

and accordingly we will not be liable to any person in relation to any contract or other arrangement between website users; furthermore we are not responsible for the enforcement of any contractual obligations arising out of a contract between website users and we will have no obligation to mediate between the parties to any such contract.

14.2    The provisions of this Section 14 are subject to Section 19.1.

15.2    You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, store, adapt, publish, translate and distribute your content in any existing or future media.

15.3    You grant to us the right to sub-license the rights licensed under Section 15.2.

15.4    You grant to us the right to bring an action for infringement of the rights licensed under Section 15.2.

15.5    You hereby waive all your moral rights in your content to the maximum extent permitted by applicable law; and you warrant and represent that all other moral rights in your content have been waived to the maximum extent permitted by applicable law.

15.6    You may edit your content to the extent permitted using the editing functionality made available on our website.

(c)       limit any liabilities in any way that is not permitted under applicable law performed solely My College Dentist; or

(d)      exclude any liabilities that may not be excluded under applicable law performed solely My College Dentist.

19.2    The limitations and exclusions of liability set out in this Section 19 and elsewhere in these terms and conditions:

(a)       are subject to Section 19.1; and

(b)      govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions.

(c)       If you are a California resident, you waive your rights with respect to California civil code section 1542, which says “a general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.”

(b)      the total amount paid and payable to us under the contract.

19.10  It is the sole responsibility of users to completely disclose all discounted treatment fees to any insurance companies they are contracted with. Failure to disclose a discounted treatment fee for a submitted claim could potentially constitute a false claim with an insurance company. My College Dentist shall not be held liable in any way for any user act of negligence to properly disclose a discounted treatment fee for a claim to an insurance company.

20.1    You hereby indemnify My College Dentist, and undertake to keep us indemnified, against any and all losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute) incurred or suffered by us and arising directly or indirectly out of your use of our Resources or any breach by you of any provision of these terms and conditions.

  1. Breaches of these terms and conditions

21.1    Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:

(a)       send you one or more formal warnings;

(b)      temporarily suspend your access to our Resources;

(c)       permanently prohibit you from accessing our Resources;

(d)      block computers using your IP address from accessing our Resources;

(e)       contact any or all of your internet service providers and request that they block your access to our Resources;

(f)       commence legal action against you, whether for breach of contract or otherwise; and/or

(g)      suspend or delete your account on our website.

24.3.1  PROMOTION DESCRIPTION: The My College Dentist Smile Proud Scholarship applications will be reset on Jan. 1st of every year at midnight, Mountain Standard Time. It is highly advised that students visit the dentist at least twice a year for their routine cleaning, exam, and necessary Xrays for a professional oral health evaluation. Staying current with your routine dental cleanings and exams will give you the best possible chance to win a scholarship!

The sponsor of this Scholarship is My College Dentist LLC (hereafter referred to as “Sponsor”). By participating in the Sweepstakes, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission or processing of Entries and the overall administration of the scholarship prizes. Entrants should look solely to Sponsor with any questions, comments or problems related to the Scholarship. 24.3.2  ELIGIBILITY: Open to legal residents of the United States who are actively enrolled in an institution of higher education. You must complete the following criteria on our scholarship page to officially apply. In order to be eligible for the Smile Proud Scholarship, you must complete the following criteria:

  1. Be ACTIVELY ENROLLED at a college or university in the U.S. and be able to provide proof (i.e. transcript)
  2. Schedule an appointment with a dentist registered on MyCollegeDentist.com and arrive to your appointment on time
  3. STUDENTS MUST COMPLETE A MINIMUM OF TWO APPOINTMENTS PER YEAR (ideally routine exam every 6 months)
  4. Post an honest and respectful review of your appointment on your dentist profile located at MyCollegeDentist.com
  5. Post a picture on either facebook and/or instagram of you smiling with your dentist, tag @mycollegedentist in the picture, and in the caption include the hashtag #MCDSmileProud
  6. Complete the application form located on the Scholarships page
  7. Complete the Rafflecopter entry contest under the application form

3 PRIZES:

In the beginning, one prize will be given out during each SMILE PROUD scholarship sweepstakes term. Amount of prizes awarded is subject to change and may increase as My College Dentist® expands and more dentists join.

1st Prize: $500 minimum cash prize that will vary each scholarship sweepstakes. Prizes may increase in value. Cash prizes are dependent on the amount of dentists that are paying members of mycollegedentist.com. Winners will be notified of the total cash prize amount when they are selected and verified.

The total value of the scholarships offered will be outlined in the official offer email. We reserve the right to offer any value of funds, as it will be dependent on the amount of dentists memberships in circulation at the time.

For the cash prize, My College Dentist® will make payment of the funds in one single installment via check by Certified Mail or online deposit, though we reserve the right to make payment in multiple installments, as we see fit. 

Scholarships are awarded based on established eligibility criteria. You must meet the eligibility requirements to receive your scholarship payment. The eligibility requirements for each scholarship are outlined on our scholarship page of our website.

Only one prize per person and per household will be awarded. Prizes cannot be transferred, redeemed for cash or substituted by winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items.
   
This scholarship is open to legal residents of the United States of America and prizes will only be awarded and/or delivered to addresses within said locations. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the prize winner. Failure to comply with the Official Rules will result in forfeiture of the prize.

Automated or robotic entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the Entrant. Any attempt by Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void Entrant’s Entries and that Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All Entries must be posted by the end of the Promotion Period in order to participate. Sponsor’s database clock will be the official timekeeper for this scholarship. The deadline to apply is December 31 of each year.

5 WINNER SELECTION: The Winner(s) of the scholarship will be selected in a random drawing from among all eligible Entries received throughout the Promotion Period. The random drawing will be conducted approximately 3 weeks after the Promotion Period by Sponsor or its designated representatives, whose decisions are final. Odds of winning will vary depending on the number of eligible Entries received.

6 WINNER NOTIFICATION: Winner will be notified by email at the email address provided in the Entry Information approximately 3 weeks after the random drawing. Potential Winner must accept a prize by email as directed by Sponsor within 7 days of notification. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any email account.

Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winners may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively “the Prize Claim Documents”). No substitution or transfer of a prize is permitted except by Sponsor.

8 LIMITATION OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this scholarship; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the scholarship; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the scholarship or download of any materials in the Scholarship.

   If, for any reason, the scholarship sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this scholarship, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the scholarship in whole or in part. In such event, Sponsor shall immediately suspend all drawings and prize awards. Sponsor and Released Parties shall not have any further liability to any participant in connection with the scholarship.
